Dear Mr. Cochran:

This is in response to your letter of October 5,1978, in which you requested, pursuant to the Freedom of Information Act, information related to comparisons of EURATOM and IAEA safeguards.

Your letter was received by the Office of Administration on October 10.

Portions of document 1 of Appendix A contain information classified pursuant to Executive Order 11652 and are being withheld from public disclosure pursuant to exemption (1) of the Freedom of Information Act (5 U.S.C. 552(b)(1)) and 10 CFR 9.5(a)(1) of the Commission's regulations.

A copy of document 1 of Appendix A with the exempt portions deleted is being placed in the NRC Public Document Room, 1717 H Street, N.W.,

Washington, D.C.

Portions of document 2 of Appendix A contain advice, opinions and recommendations of the staff and are being withheld from public disclosure pursuant to exemption (5) of the Freedom of Information Act (5 U.S.C.

Sb2(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.

A copy of document 2 of Appendix A with the exempt portions deleted is being placed in the PDR.

One additional document subject to your request was originated by the Department of State and has been referred to that agency for direct response to you.

Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.

The person responsible for the denial of the withheld portions of document 1 of Appendix A is Mr. Ken Pedersen, Director, Office of Policy Evaivation.

The persons responsible for the denial of the withheld portions of document 2 of Appendix A are the undersigned and Dr. Clifford V. Smith, Jr., Director, Office of Nuclear Material Safety and Safeguards.

The denial by Dr. Smith and myself may be appealed to the Executive Director for Operations within 30 days from the receipt of this letter.

Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, D.C.

20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." The denial by Mr.

Pedersen may be appealed within 30 days to the Commission and should be addressed to the Secretary of the Commission.
