AGREED MOTION FOR SPECIAL PREHEARING CONFERENCE AND TO SET SCHEDULE FOR FURTHER PROCEEDINGS Commonwealth Edison Company

(" Edison"), the Attor-ney General of the State of Illinois, intervenor herein, and the NRC staff have for some time been participating in an informal process of discovery and negotiations with respect to the contentions filed by the Attorney General in this matter.

The parties hereby jointly request that a special prehearing conference be held in this matter on November 20th, 21st or 22nd, 1978 at Zion, Illinois for the following purposes:

1.

To hear oral arguments and rule on motions to dismiss in respect of those contentions which the parties have not reached agreement and which may present purely legal issues; 7 811 13 0 9<>9-

To set a schedule for further actions in this proceeding; and 3.

To allow interested citizens to enter limited appearances and submit oral or written statements.

The parties anticipate that on October 27, 1978 they will identify which of the contentions filed by the Attorney General vill be addressed in motions to dismiss to be submitted by Et'ison or by the staf f.

Further, the par-ties are agreed that,:ritten briefs in support of or opposi-tion to such motions will be filed by all parties on Novem-ber 9, 1978.

The opportunity for oral arguments is requested at the special prehearing conference to enable the parties to respond to any questions which may be raised due to such simultaneous submission of briefs.

The parties believe that the special prehearing conference should be held in Zion so that interested citi-zens may more easily make limited appearances in this pro-ceeding.

The Attorney General believes that many persons will want to submit oral or written statements and conse-quently the special prehearing conference may last more than one day.

The parties have also reached the following ten-tative agreement as to the schedule for further proceedings in this matter.
