EP4 s CONSOLIDATIO:: OF I:OIAN POINT UNITS NOS. 2 AND 3 HEARINGS { By motion dated January 2, 1973, the Hudson River Fishermen's Association f (HRFA) and Save Our Stripers (505) moved that the comission consolidete -l 4 the hearings of Indian Point Units Nos. 2 and 3, pri-arily based on the E On January 19, intervenors' cnntentions regarding environmental < the applicant repited by opposing the motion to ', da te. On January 23, 1973, the intervenors provided additional st ing documentat'un regarding this nation. A special ASLB issued a her.orandum and Order on Febrary 28, 1973 which stated that the Intervention Board had no jurisdiction to consider the motion but invited all petitioners to re-3,p spond to the intervenors' riotion and referred the notion to the Licensing ASLB. The sane Licensing AS' B as that in the IP-2 case was established on February 28, 1973. On March 0,1973, the applicant filed a motion i g for reconsideration of the Intervention Board's Order to withdraw the ~ L invitation to respond to the HRFA and SOS raction to consolidate. P 3 Af ter a special prehearing confc.'ence en May 21, 1973 to discuss issues j of contention and plans for future hearings, the ASLB requested that j the partiet agree to stipulate to incorporate the record of the Docket 4 No. 50-247 proceeding by reference into the Docket No. 50-286 proceeding ,j rather than consolidate the two proceedires. On August 3, 1973, all the parties stipulated and on August 17, 1973, the Board ordered, among / 'i other matters, that the parties designate portions of the transcript a in the Docket No. 50-247 proceeding to be incorporated into the Coctet 7 d No. 50-286 proceeding. In response to the order, the HRFA and 505 submitted on Septenber 24, 1973 a list of pages of the transcripts of '1 h Docket 30. 50-247 to be transferred into the Docket No. 50-286 proceeding.
