Dear Mr. Miller:
The Public Utilities Board of the City of Brownsville, Texas
("Brownsville") and Central and South West Corporation ("C&SW) presently have motions pending before the Licensing Board on the issue of whether Mr.
S.
B.
Phillips, Jr., Chairman and Chief Executive Officer of C&SW, will be produced for deposition in accordance with Brownsville's Notice of Deposition.
Brownsville originally sought to take Mr. Phillips' deposition on January 8, 1980.
The January 8, 1980 date is no longer feasible, in part since I have not been able to arrange an oral argument on the issue because counsel for C&SW is out of town.
. I have discussed this matter with counsel for C&SW, who agrees that the issue is whether Mr. Phillips will be deposed at all, not the date of deposition.
Accordingly, I request that, should you hold that Mr. Phillips should be deposed, you require him to be produced promptly after the date of your ruling.
If you continue to feel oral argument would be helpful, I will be haeov to make arrangements for it.
