Dear Mr. Brinker:

Your letter of November 8,1979, to President Carter has been referred to this office for reply. You referred to the age of Big Rock Point, the Findings of the President's Commission en the Accident at Three Mile Island a..d upressed concern on behalf of the Charlevoix City Council with respect to Big Rock Point going back on line.

Although the Big Rock Point Plant is one of the oldest currently operating nuclear power plants in the country, its period of operation is less than half of its 40-year design lifetime.

3roughout the life of the plant, our staff continually reviews plant safety and experience and requires changes in equipment or operating practices when they are deemed to be necessary to assure an acceptable level of safety.

With respect to the reconmendations of the President's Commission on the Accident at Three Mile Island, we are taking actions to implement nearly all the recommendations and in a number of cases going beyond those recommendations.

A number of administrative and procedural changes resulting from our review of the Three Mile Island accident nave already been implemented at all operating nuclear power plants including Big Rock Point.

The Big Rock Poir.t Plant will be shutdown prior to January 1,1980, to complete implerentation of short term requi reme nts. Other changes requiring longer times for engineering design and procurement will be implemented by January 1,1981.

Consumers Power Company completed the Big Rcck Point Plant outage for refueling and repairs on November 6,1979. Prior to its return to operation, the NRC staff performed reviews and on-site inspections of the work conducted during the outage.

By petition dated November 4,1979, I was requested by two residents of your area to issue an order delaying res art of the Big Rock Point Plant pending resolution of seven iss.es identified in the 1792 N 80032303fc

Mr. James M. Brinker petition.

Since the Comission did not receive the request prior to the restart of Big Rock Point, I have treated the petition as a request for an order to show cause why the operating license should not be suspended pending resolution of the issues (copy enclosed).

We have not taken action on this petition at the present time.

A copy of our action on the petition will be placed in the Charlevoix Public Library and hopefully will provide further assurance that necessary actions are being taken to ensure the safety of the citizens of Charlevoix.
