Dear Mr. Helfrich:
Enclosed please find an application from Nissho-Iwai American Corporation for a license to export 7587.75 Kilograms Uranium enriched to 145.685 Kilograms Uranium-235 for use as reload fuel for the FUGEN heavy water reactor.
We are referring this application to the Executive Branch because your November 21, 1979 letter authorizes NRC to license only reloads for light water moderated power reactors.
Before taking action on this license application, we would appreciate your views, in accordance with established procedures and from the overall perspective of the Fxecutive Branch, as to whether the issuance of the requested license would be inimical to the inte:ests of the United States, inc~iuding the common defense and security, and whether the proposed export meets the applicable criteria in the Atomic Energy Act as amended by the. Nuclear Non-proliferation Act of 1978.
