SUBJECT:
A PRELIMINARY LOOK AT HEARING PROCESS DURATION FOR L.S. NUCLEAR POWER REACTORS In our memorandum to you dated September 21, we indicated that we would send you an analysis of the duration of the hearing process for U.S. nuclear power reactors.
The purpose of this memorandum is to describe the analysis we have done and to show you the preliminary results.
Investigation of the duration of the hearing process was assigned to the Applied Statistics Branch of.9A.
The first task was construction of a cata base which included dates corresponding to numerous milestones in the licensing process, involving both the Construction Permit (CP) phase and the Operating License (OL) phase.
In the course of gathering and scrutinizing the relevant information, irregularities were discovered, primarily in the historical data (dates in the development of the hearing process for the variou: reactors). The Applied Statistics Branch is still attempting to reconcile data discrepancies among several sources available to us.
Despite the data discrepancies, we think it is now possible to give you a preliminary overview of the results. Although we do not have confidence that all of the individual dates are correct, we feel enough of them are correct (or nearly correct) to show the general trend of hearing process durations over about two decades of licensing activity.
The enclosed charts are constructed from the existing data base.
The charts give a general indication of the duration of the hearing process; this duration is defined as (a) the interval from issuance of the Safety Evaluation Supplement (SES) to the ASLB decision on radiation and safety matters for the safety hear-ing, and (b) the interval from issuance of the Final Environmental Statement (FES) to the corresponding ASL5 decision for the environmental hearing.
The trend over 21 years for tne average hearing caration (in months) is portrayed at the top of Chart i for the CP phase anc at the top of Chart 2 for the OL phase.

Commissioner Kennedy In addition to displaying the average length of the hearing duration, we feel it is also useful to look at average hearing duration as a percentage of average total length of the corresponding licensing phase (from the appropriate docket date to CP issuance or to 0L issuance, whichever is applicable).
This percentage is given by year of docket at the bottom of each chart.
(Some reactors are subject to a " combined" hearing for one or both phases, but these data are not included in this preliminary analysis.)
i The preliminary results are summarized below:
The CP hearing duration, as shown in Chart 1, averaged less than 3 months for the safety hearings for reactors docketed prior to 1968.
Excepting the year 1971, the corresponding average hearing duration rose to about 8 months for reactors docketed in the years 1968 through 1976.
The OL hearing duration, as shown in Chart 2, averaged about 3 months for the safety hearings for reactors docketed in the years 1958 through

1961.
Excepting the year 1973, the corresponding average hearing duration rose to approximately 11 months for reactors docketed in the years 1968 through 1974.
It is inappropriate at this time to try to establish the nature of the safety hearing duration for reactors docketed for OL between 1962 and 1967 because of missing historical data.
For the CP phase, the environmental hearing data are sca.ttered, averaging approximately 15 months, whereas for the OL phase, they indicate an in-creasing duration.
Generally speaking, the hearings in the 1970s constitute a larger share of the length of the CP and OL phases than in the 1950s and the 1960s.
Again, we want to stress that the above results are preliminary.
However, the Applied Statistics Branch is preparing a comprehensive report on this matter, and we expect its completion in March 1980.
