This letter relates to a March 12, 1979 telephone conversation between Mr. G. Pollak and Ms. L. Bare of your cogany arid itssrs. Skelton and Matthews of the f;RC staff regarding " vital areas" at the McGuire fiuclear Station during storage of Oconee spent fuel as may be authorized by amendment of your Materials License I;o. St;M-1773.

Confirning the position expressed by the NRC personnel during the above conversation, we have determined that the substantial curie quantities of fission products that are present reouire that the irradiated fuel be protected as " vital equipment" as defined in 10 CFR 73.2(i) and, as such, shall be located within a " vital area" as defined in 10 CFR 73.2(h).

As was further pointed out, this position is consistent with the views of the f;RC Reactor Safeguards Licensing staff as pertains to the storage of irradiated fuel at facilities which come under the, rovisions of 10 CFR 73.55.

It is our understanding that you intend to fornally submit a complete physical protection plan addressing the specific requirements of.573.50 in support of your application for amendment. This plan should incorporate material responsive to the contingency planning and guard qualification and training provisions required by Is73.50(a)(4) and (g) and delineated in Appendices B and C of 10 CFR Part 73.

In order to complet'e our review of this material in a time frame compatible with the schedule established for review of your amendment request, your plan submittal is requested within twenty (20) days of receipt of this letter.
