This letter concerns our review of the Transnuclear, Inc. Safeguards Contingency Plan for Transportation and Transfer Points which was transmitted to us by your letter of September 19, 1978. On the basis of our review, we have determine <1 that your plan is acceptable subject to the changes / modifications as noted below and in the margins of the plan (enclosed).

Your plan contains all of the required sections, however, some supple-mental information and revision are required. Specific examples follow.

1 - The plan does not address the operations envisioned during the period the material is aboard the shipment vehicle (ship or ai rcra ft).

2 - There are no provisions for contingencies which may arise at a foreign port where there is a transfer of security responsibility.

3 - The Movement Control Center (MCC) has been delegated to Tri-State Motor Transit Company, Joplin, Missouri, for over-the-road por-tions of an export or import, but there are no provisions for an MCC during other phases of the shipment.

4 - Basically the plan is generic; however, for departure / arrival ports the plan is very specific, limiting reference to Port Columbus and Dulles International Airport facilities. Reference to specific locations should be placed in annexes to the plan and generic reference substituted in the basic plan as much as possible in order to tailor it so that it could be applied universally.

- 5 - Marginal notes have been made to the plan to assist you in clari fying certain points.

Please make the changes / corrections / additions / deletions as appropriate and furnish us six copies of your finalized plan as soon as possible.

We have determined that the enclosure to your letter of September 19, 1978 contains information of a type specified in 10 CFR 2.790(d).

Accordingly, it is deemed to be commercial or financial information within the meaning of 10 CFR 9.S(a)(4) and shall be subject to dis-closure only in accordance with the provisions of 10 CFR 9.12.
