Dear Mr. Saltzman:
This is co confirm our conversations of May 7th and May 8,
- 1979, concerning your letter to Westinghouse of August 14, 1978.
You indicated during these conversations that it was not necessary for Westinghouse to sign the amendment of Article VIII to the Indemnity Agree 2 e: #B-56.
Westinghouse had raised significant questions regarding toe application of Article VIII to the Zion facility as reactors which produce less than 100 MWe are not subject to retrospective premium asses / ment.
Hopefully, the lack of clarity of the application of Article VIII with respect to test and research reactors will be corrected in the near future.
Until that time, you have agreed that Westinghouse need not sign Amendment #7 to the Indemnity Agreement.
