e Aopendix A NOTICE OF VIOLATION North Memorial Hospital License No. 22-05792-01 License No. SNM-1438 Based on the inspection conducted on January 25, 1979, it appears that certain of your activities were in noncompliance with NRC requirements, as noted below.

Items 1, 2 and 5 are infractions, and items 3 and 4 are deficiencies.

License No. 22-05792-01 1.

Paragraph 10 CFR 20.207(b), Title 10 of the Code of Federal Regulations, Part 20, requires licensed materials in an unrestricted area and not in storage shall be tended under the constant surveillance and i= mediate control of the licensee.

In addition, License Condition No. 13; letter dated January 17, 1975, Section No. 3, specifies that off-duty hours receipts will be placed in a locked, restricted area.

Contrary to the requirement, as of t'le date of this inspec-tion, licensed material delivered before 7:00 a.m. has been placed on floor outside of the Nuclear Medicine Hot Labora-tory, in an opan hallway, an unrestricted area where material was not under constant surveillance and not secure from unauthorized removal.

License Condition No. 13 of NRC Byproduct Material License No.

22-05792-01 Section 9 of letter dated January 17, 1975, specified, in part, that survey instrument are to be calibrated on all ranges quarterly by the University of Minnesota.

Contrary to this requirement, as of the date of this inspection, survey instruments have been calibrated only two times eacn year.

License Condicion No. 13 of Byproduct Material License No.

22-05792-01; Section 5 of letter dated January 17, 1975, specifies, in part, that weekly surveys will be kept on file in the Nuclear Medicine Department.

Appendix A Contrary to this requirement, as of the date of this inspection, records of surveys performed for the week of September 16 through October 6, 1978, were not available as specified.

Paragraph 10 CFR 20.401(c)(3), Title 10 of the Code of Federal Regulations, Part 20, requires, in part, that records of dis-posal of licensed naterial shall be maintained until the Com-mission authorizes their disposition.

Contrary to this requirement, as of the date of this inspection, no records of the disposal of licensed material had been maintained.

License No. SNM-1438 5.

Paragraph 10 CFR 30.3, Title 10 of the Code of Federal Regulations, Part 30, requires, in part, that no persons shall receive, own, possess, use, etc., byproduct material except as authorized in a specific or general license issued pursuant to the regulations in this chapter.

Contrary to the requirement, although NRC License No.

SNM-1438 expired on December 31, 1978, material is being used in that nuclear pacemakers implanted under the license remain in patients who require follow-up.
