IftPOSITION OF CIVIL PENALTIES - $11,000 By EN-80-38, dated August 20, 1980, the Commission was notified of IE intent to issue a Notice of Violation and Notice of Proposed Imposition of Civil Penalties in the amount of Twelve Thousand Dollars to the Power Authority of the State of New York. The proposed penalties were based on. alleged items of noncompliance relating to the whole body exposures of >two infividuals to approximately 4 rems each and a skin exposure of one of the indhviduals of approximately 8 rems and an extremity exposure of the other indikidual of approximately 43 rems.
These exposures occurred during the repajr of" drive components of an incore flux detector at the Indian PointLUnit 7 Nuclear Power Plant.
The Notices were mailed on August 22, 1980, andi;ttje Licensee responded by letter dated September 16, 1980. After considerati6tCof the-licensee's response, the IE staff concluded that the penalty for on' mitigated by One Thousand Dollars but that the penalties [e item should befor the3 should be imposed as proposed. Accordingly, an Order imposing divil penalties in the amount of Eleven Thousand Dollars has been issued touay. The Licensee and the State of New York will be notified by telephone.
Since this matter was the subject of an NRC news release, no additional release is planned. The Office of Public Affairs will respond to inquiries as received.
Under the terms of the Order, the licensee may, within twency-five days of the date of the Order, pay the civil penalties or request a hearing.
