Dear Commenter:

g During the September 12th,1979, Clean Water Commission meeting, the 2k Missouri Clean Water Commission reviewed the facts from the informational D q hearing held at the request of the public on the proposed issuance of the Q-NPDES permit to Combustion Engineering. It was the ruling of the Clean (f) v Water Commission at this time to refer the matter back to the technical LU staf f of the Water Pollution Control Program.

C0 Water Pollution Control Program technical staf f has reached a decision that the permit, as proposed, should be issued to the Combustion Engineering

< 'om facility.

The staf f action is appealable to the Clean Water Commission Co as established under Chapter 204. However, the Clean Water Commission O.E has requested that I advise the general public that they will only consider I-- 2 water quality comments in their review of the NPDES Permit for this facility, Ii if it is appealed. Most of the inforr:ational material that was obtained Z5 during the public hearing in Hillsboro was very beneficial and very enlightening to the Clean Water Commission on nuclear power; but the c

11-O Commission will only consider water quality comments as mandated by O 3_

Chapter 204.

HN This staff action is effective on September 21st, 1979 and according to Z.

Chapter 204 Revised Statutes of Missouri, anyone who feels that they have LU 3 been aggrieved by this action must appeal within thirty (30) days of the

] E5 staff action. The appeal should be directed to Richard F. Rankin, P.E.,

g]

Director of Staf f, Missouri Clean Water Commission, P. O. Box 1368, Jef ferson yo City, Missouri 65102, and must state the specific water quality comment a

that is the basis of the appeal.

If you have any questions or wish to 2

pursue this further, please contact Robert H. Hentges of my staff.
