NRC STAFF'S REQUEST FOR AN EXTENSTON OF TIME TO RESPOND TO ACORN'S RESPONSE TO NRC STAFF'S STATUS REPORT ON PROPOSED STIPULATIONS AND ACORN'S REQUEST THAT THE NRC STAFF BE ORDERED TO FURTHER NEGOTIATE ADMISSIBILITY OF PROPOSED CONTENTIONS On February 11, 1980, ACORN filed, in the captioned proceeding, " ACORN's Response to NRC Staff's Status Report on Proposed Stipulations and ACRON's Recuest That the NRC Staff Be Ordered to Further Negotiation [ sic] Admissi-bility of Proposed Contentions."

(ACORN's Response and Request) Therein, ACORN asserts that there has been no meaningful discussion of the admissibility of ACORN's proposed contentions and requests that the NRC Staff be ordered to discusa and negullate the admissibility of ACORN's proposed contentions and/

or reveal to ACORN specific reasons for the Staff's alleged refusal to agree to admissibility.

The NRC Staff's response to this request is due on March 3, 1980.

Since the Staff's receipt of ACORN's Response and Request, Staff counsel assigned to this proceeding has been deeply involved in a number of pressing matters with regard to other assigned cases.

F,ecause of this, counsel has been unable to complete preparation of the Staff's response and will be unable to file that response by March 3, 1980.

Accordingly, the Staff here-with requests an extension of one week, until March 10, 1980, in which to respond to ACORN's Response and Request.

Q 800304o 2'3%

. Counsel for ACORN and counsel for the applicant have indicated that they have no objection to this Staff request for an extension of time and have authorized the Staff to so indicate in this motion for time extension.

Respectfully submitted, l=dsf/
