Dear Mr. Klein:

This is to confirm the discussion Mr. Ashley held with you and members of your staff following our review and evaluation of the Idaho radiation control program conducted December 3-6, 1979. The review covered the principal administrative and technical aspects of the program.

This included an examination of the program funding and personnel resources; licensing, inspection and enforcement activities, field evaluations of a State inspector, emergency response capabilities, and the status of the State's radiation control regulations.

As a result of our review of the Department's program and the routine exchange-of-information between the Nuclear Regulatory Commission and the State, the staff believes that the Department's program for regulation of agreement materials is adequate to protect the public health and safety and is compatible with the Commission's program.

Staff turnover and special problems, such as current INEL environmental questions, have placed a tremendous burden on the staff's ability to keep up with routine licensing and compliance activities. We urge every effort be made to fill the current vacancy in the radiation control program.

The process of revising the Idaho radiation control regulations has been proceeding at an extremely slow pace. We believe the effort needed to prepare the required synopsis should be given high priority.

I would appreciate your response to the above comments. Enclosed is a copy of a letter to Mr. Funderburg regarding the technical aspects of our review.

I am also enclosing a second copy of each letter which should be placed in the State Public Document Room or otherwise made available for public review.
