9 MR. CHILK This is SECY A-79-53, further consideration 10 of response to U.S. Circuit Court of Appeals Decision in the 11 Gainesville Utilities Department versus Florida Power & Light 12 Company.
13 A_ majority of the Commission consisting of s
14 Chairman Ahearne, Commissioner Gilinsky, Commissioner Kennedy 15 and Commissioner Hendrie have approved the recommendation of 16 the General Counsel in a paper, that the Commission deny the 17 institution of a 105A proceeding.
18 And you have specifically approved an order that 19 was circulated to you by the General Counsel under date of 20 December 19.
21 Commissioner Bradford dissents and transmitted his 1,.
22 dissenting opinion to you on December 20th,1979 in two papers:
23 One indicating the opinion and one revising a 24 page 4.
