Dear Mr. Dougherty:
On December 5, the Appeal Board entered an order calen-daring your appeal in the abcVe-styled proceeding for oral argument at 9:30 a.m. on Thursday, January 3, 1980 in the NRC.Public Hearing Room, 5th floor, 4350 East-West Highway, Bethesda, Maryland.
The order directed each party to notify me, by letter mailed no later than December 21, of the name of the counsel who will present oral argument on its or their behalf.
I mailed a copy of the order to you on the date of its issuance.
When the required letter had not been received from you by yesterday morning's mail, I endeavored to call you.
I was informed by the person who answered the telephone that you were on vacation.
She did not know whether you had re-ceived the December 5 order or had 'sent me the required let-ter.
.The Chairman of the Appeal Board has ascertained, how-ever, that you were informed of the December 5 order (and the date, established for the argument) in a telephone conversa-tion with counsel for the NRC staff which took place shortly after the order had issued.
On this basis, the Board is proceeding on the assumption that you are aware that the appeal is to be heard on January 3 and that you will be present at the appointed time on that date to present oral argument on behalf of your clients.
