Dear Mr. Will:

This is to confirm the coments made to you and your staff regarding the recent regulatory program review held by Joel Lubenau.

Based upon the results of the review, the staff believes the State's program for control of agreement materials is adequate to protect the public health and safety and is compatible with the Comission's program.

We believe development and documentation of procedures is needed (or needs to be completed) in the following areas:

1.

Inspection Guides need to be issued to the staff.

(We recomended thislastyear);

2.

Internal procedures for collecting uranium mill license and inspection fees and for accounting of State costs; 3.

Internal procedure governing staff actions, responsibilities, communications, etc. during emergency responses; 4.

Improved procedures for developing statistical information on the compliance program; 5.

Procedures to assure reports of incidents are properly followed-up; and 6.

Procedures governing escalated enforcement action.

The time between inspections and dispatch of enforcement correspondence was found to be unduly long in some cases. We recommend enforcement letters be sent within 30 days of the inspection, especially when significant health and safety pioblems are found.

Smoke tubes should be obtained and made available to the inspectors for use in evaluating ventilation patterns.
