NRC STAFF MOTION FOR ORDER COMPELLING CITIZENS FOR EQUITABLE UTILITIES, INC. TO RESPOND TO STAFF INTERROGATORIES On November 5, 1979 the NRC Staff filed a series of interrogatories directed to the Citizens for Equitable Utilities, Inc. (CEU) in the captioned pro-ceeding. The discovery schedule established by this Board provides that responses to these interrogatories were to be filed by CEU by Deceuber 21, 1979.
As of today's date, the Staff has received no responses to those interrog-atories. Since answers to the Staff's interrogatories were not filed within the prescribed time period, nor timely objections interposed, the Staff respectfully requests, pursuant to 10 CFR E 2.740(f), that the Licensing Board issue an order compelling CEU to provide promptly, in writing under oath, full, direct and responsive answers to the Staff's set of interrogatories, dated November 5, 1979.
