ANSWER OF THE NRC STAFF TO MOTION OF HOUSTON LIGHTING

& POWER COMPANY TO COMPEL FURTHER DISCOVERY On October 1,1978, Houston Lighting & Power Company ("HL&P") filed its "First Set of Interrogatories and Requests for Production of Documents" addressed to the NRC Staff. On December 1,1978, the Staff answered these interrogatories (in great detail in many instances) and produced numerous documents in response thereto. As discussed below, this pleading is in response to HLLP's motion, filed on November 30, 1979, requesting the Board to order further responses to said interrogatories.

For its part, the Staff has, since December 1,1978, been availing itself of the discovery opportunities allotted to all parties by the Board.

The Staff has served interrogatories and document requests as well as participated in numerous depositions. As HL&P's motion recognizes, "the parties have had...

time and opportunity to accuire whatever information they needed..." to pro-vide more complete responses (HL&P Motion, p. 4 (emphasis added)).

As of now, the Staff is at the point of synthesizing and analyzing the accuired in.for-mation while continuing its discovery efforts.

2 Now, with no forewarning, or discussion, or the courtesy of informal notice, comes HL&P with its formal motion to compel discovery.

It should be noted, that not once prior to the filing of its motion, did HL&P even informally request updated answers to HL&P's interrogatories. The Staff would have liked the opportunity to discuss with HL&P a mutually agreeable time-table for the exchange or providing of additional documents end updated resnonses before this matter was brought before the Board by HL&P.

This Board has on more than one occasion directed the parties to this proceeding to first attempt to re-solve conflicts informally where they arise in the discovery context.

The timing of the HL&P motion is also interesting.

It.as hand-delivered to the Board and to the Commission's H Street office on a Friday afternoon, November 30, 1979.

Yet, a copy was not received in the Staff counsel's mailroom until the following Tuesday (December 4th).

Further, HL&P's motion requests Board action on December 14, 1979, -1/

which is prior to the time the Staff response is due under 10 CFR 5 2.730(c).

As mentioned above, the Staff will be happy to work with HL&P to arrive at a mutually convenient schedule for further Staff responses to HL&P's interroga-tories.

Indeed, the Staff itself had been planning upon a follow-up pro-duction of documents within the next two weeks. Accordingly, the Staff respectfully requests that HL&P's motion be denied without prejudice pending
