December 4, 1979 ORDER RELATIVE 'IO PROPOSED NEW SCHEIELE On October 24, 1979, California Energy Comission (CEC) requested the Board to reconsider tre then current schedule of a prehearing conference on November 7, 1979, and the evidentiary hearing scheduled to commence on November 27, 1979 On November 2, 1979, (following phone notification),the Bo,ard cancelled the prehearing conference due to the sudden illness of the Board Chairman.
On November 8, 1979, the NRC Staff submitted a filing entitled " Joint Response to CEC's Motion for Reconsideration of the Schedule for Discovery and Hearings" on behalf of all parties.
The following schedule was proposed by all parties:
Final requests for discovery to be served
. December 17, 1979 Final responses to discovery to be served January 17, 1980 Motions for sumrary disposition to be served.

February 4, 1980 Testimony to be served on all issues not subject to motion for sunmary disposition February 11, 1980 Commencement of hearing February 26, 1980 The parties also reached the following understanding relative to the proposed schedule:

The time for responses to discovery will be governed by the Conmission's Rules of Practice (10 CFR 55 2.740 - 2.744) or as otherwise agreed to between the party seeking and the party responding to discovery.

Discovery will proceed on the two issues resubmitted by CEC's pleadirg of October 24, 1979 */ without awaiting a Board ruling on their admissibility.
3 The proposed senedule does not cover emergency planning issues. Those issues are before the Licensing Board on the " Motion of the California Energy Conmission for Reconsideration or, in the Alternative, for Certification to the Conmission" (October 24, 1979). Responses to that motion by parties other than the NRC Staff are due 'on November 8, 1979, with the Staff to respond by November 13, 1979 It was the consensus of the parties that should the Licensing Board or the Comission order that the emergency planning issues be considered in this proceedirg, a separate discovery and hearing schedule could be established with respect to those issues.
The Board adopts the proposed schedule and agrees that the understandirg reached relative to the schedule is reasonable. The Board is aware that dis-covery is proceeding and congratulates the parties for the various acconmoda-tions that have been reached. Both Licensee and Staff have responded favorably, on November 8 and 13, 1979, respectively, to the two issues proposed in CEC's filing of October 24, 1979 The Board admits the two issues and will by
