Dear Mr. Dircks,
In response to the above referenced Order, Duke Power does not request a hearing at this time. Duke and/or NAC will provide the data requested in the order as soon as possible as has been discussed with your staff.
It is anticipated that the suspension of 71-6698 can be lifted for the casks for which the data has been acquired in a timely fashion. The resolution of this matter is of considerable importance to Duke since at least one of the casks needs to be utilized in the very near future.
The cask needs to be used to ship some non-f uel core components of f-site in order to facilitate and promote ALARA dose committments in the re-racking of the Oconee Unit 1, 2 Spent Fuel Pool which is scheduled to begin in early June. We will continue to cooperate to the fullest extent possible toward the final resolution of this matter.
