Noncompliances at Enrico Fermi Unit II Construction Site This letter responds to the two (2) infractions contained in your IE Report No. 50-341/79-05. This inspection of Enrico Fermi Unit II Site Construction activities was performed by Messrs. J. Hughes, J. F. Suermann, and P. A. Barrett on March 6 - 9, 1979.
Only the cited infractions mentioned in your report are discussed in this reply, as required by Section 2.201 of the NRC's " Rules of Practice", Part 2, Title 10, Code of Federal Regulations. The un-resolved items have been acted on.
We will be prepared to report in detail on our progress and corrective action on these matters to your inspectors on their next visit.
The enclosed response is arranged to correspond to the sequence of items cited in the body of your report. The finding numbers from the report are referenced as well as the section numbers.

Response to NRC Report # 50-341/79-05 Statement of Infraction 79-05-06 Appendix A, Item # 1 Section II, Paragraph 2.b(2)
Infraction:
Contrary to 10CFR50, Appendix B, Criterion V, activities affecting quality which were prescribed by documented instructions were not accomplished in accordance with these established instructions, procedures, or drawings.
Required density tests were not taken relative to backfill for the RHR Building.
Corrective Action Taken and Results Achieved:
A review of the Backfill Inspection Reports and the. Backfill Test Reports was performed in order to further evaluate the quantities of backfill and the locations of the tests to determine the areas of fill that were not adequately tested.
Based on the results of this review, DDR #C-2663 was issued on 4/4/79, which identified the 3 areas of backfill that were not tested in accordance with the specification.
Engineering disposition of this DDR requires retesting of questionable areas.
Corrective Action to be Taken to Avoid Further Noncompliance:
Co=paction tests were performed on the backfill based on quantity estimates provided by the contractor. At the time of backfill placement, there was no procedural requirement regarding the communication method to be used to notify the testing representative.
To avoid further noncompliance of this nature, Daniel procedures concerning backfill (QCP-IV-119 and WP-II-101) will be revised to establish the contractor's responsibility for providing the Quality Control Department with accurate backfill quantities on a daily basis.
Date When Full Compliance will be Achieved:
Retests and procedure revision will be completed by June 30, 1979.
