SUPPLEMENTAL MOTION BY RESPONDENT GULF STATES UTILITIES COMPANY FOR A PROTECTIVE ORDER AND AN ORDER SETTING CONDITIONS FOR COMPLIANCE WITH SUBPOENA Respondent Gulf States Utilities Company (" Gulf States")

has sought a protective order and an order setting terms and conditions for compliance with the subpoena issued by this Licensing Board at the request of the Public Utilities Board of the City of Brownsville, Texas ("Brownsville"). In re-viewing the documents for which Gulf States has asserted a '

claim of privilege based upon proprietary and confidential business information, it has come to the attention of counsel that this Licensing Board has already ruled upon the avail-ability of some documents covered by Gulf States' proposed protective order.

By Order dated April 16, 1979, this Board denied the NRC Staff's Motion to Compel Further Answers by Houston Lighting & Power Co. ("HL&P"), stating that HL&P's objection to the production of " documents generated by HL&P and other 2236 189 7 906 0 40 39D .

parties solely as part of negotiations to settle this pro-ceeding" would be sustained. These documents demanded by the NRC Staff's Motion to Compel Production have also been demandqd by the outstanding subpoena served on Gulf States.

Inasmuch as the Order of April 16, 1979 clearly establishes the law of the case as regards documents prepared by HL&P and other parties, including Gulf States, solely as part of nego-tiations to settle this proceeding, the p otective order pro-posed by Gulf States should be amended to exclude such documents.

Obviously, it was not the intention of the Licensing BoaI. in issuing its subpoena to Gulf States to permit one party to obtain documents denied another party in the same proceeding by resort to a different discovery procedure. Accordingly, a new paragraph 16 should be added to Gulf States' proposed order as follows: " Gulf States need not produce any documents generated by Gulf States and any other parties solely as a part of .legotiations to settle this proceeding."
