Discussion:
On January 3,1979, Transnuclear, Inc., applied for a license to import 5,500 kilograms of uranium, enriched l'
to 2.3% U-235, as UF6 from France.
(Applicationat Appendix A). This material was obtained through the reprocessing of U.S. origin material and was inten(ed for use as feed material against further product to be shipped for the KNK-II reactor at Karlsruhe, Germany; however, in anticipation that U.S. import authority could not be obtained in time to meet the contractual feed delivery date, other feed for the KNK-II product was obtained from a dcmestic source.
1 The 5,500 kilograms of LEU will be returned to the U.S.
for credit against future product deliveries to other Euratom facilities or for sale. Any export of product derived from this feed will be the subject of separate licensing review.
The material will be shipped by sea and trucked to the 0.0.E. facility at Oak Ridge in four approved containers bearing IAEA Certificate of Competent Authority Number

l USA /4909/B()F. This container has been used for the shipment of thousands of tons of UF6 without a significant incident, and as noted in previous papers covering proposed imports of UF6 (example:
see SECY 78-635), this import will not result in any significant change in the probability of a potential accident and will have no environmental impact over that resulting from domestic transport of UF -
6 The radiological impacts from import shipments were further evaluated in the Final Environmental Statement of the Transportation of Radioactive Material by Air and other Modes, NUREG-0170, and were determined to be negligible compared to impacts from domestic shipments.
The staff finds that this import will not be inimical to the common defense and security, will not constitute an unreasonable risk to the health and safety of the public, and vill have no significant environmental impact.
NMSS Technical Review:
NMSS notes that the application ~
does not identify the destination of any subsequent export. Accordingly, it is impossible at this time to provide any information concerning the adequacy of safeguards to be applied to this material upon any subsequent export.
OIP COMMENTS With respect to the proposed reexport of material involved here, IP notes that, if this occurs, it will be the subject of separate Executive Branch and NRC reviews of statutory requirements, including the safe-guerds aspects. The applicant is aware that license authority for an import does not imply that a proposed subsequent export will be approved.
Reccamendation:
That the proposed import license be issued to Transnuclear, Inc.

0 ELD has no legal objection. Because the ultimate destination of the material is unknown, NMSS is unable to ascertain whether there are any foreign physical security or IAEA safeguards issues associated with this import.
