NATURAL RESOURCES DEFENSE COUNCIL REQUEST FOR EXTENSION OF TIME The Board as established May 4 as the deadline for filing motions for summary disposition.
We believe there are several issues, particularly Contentions 1, 2,
3, and 4, which are susceptible to summary disposition as to at least some aspects.
Applicant's incomplete answers to our request for admissions and the need to travel to Charlotte to view documents produced by the Applicant has substantially delayed us in preparing these motions.
We request an extension of time through May 21, 1979, or ten days after Applicant provides legally sufficient responses to our request for admissions, for filing motions for summary disposition.
Because a number of the basic facts appear to be uncontested, although it is somewhat difficult to get the Applicant to so admit, we believe overall resolution of the issues involved here will be expedited if this extension is granted.
