MOTION FOR EXTENSION OF TIME 'y 0037 On March 28, 1979 The Commission filed and served a

" Scheduling Order" in the captioned proceeding, which provided that the Applicants may file a brief response within 8 days of this Order and the Staff within 10 days.

The Scheduling Order was not received at the office of the Counsel for South Carolina Electric & Gas Company ("SCE&G")

until today. We are informed that the same is true in the case of the South Carolina Public Service Authority (" Santee-Cooper") .-1/

SCE&G hereby moves for an extension of time in which to file its response for two weeks or until April 19, 1979. The-time remaining does not permit the review of the necessary docu-mentation and the preparation of the response by April 5 relating to the new matters raised by Central Electric Power Cooperative 1/ It appears that the Office of the Secretary notified the Staff of the existence of the Order by telephone. No such notification was given Applicants.

in its submissions of March 19 and March 22, 1979, which the ,

Commission has ruled it will receive. These documents involve the review of transcript of a conference with central, and other material related to its allegations, which are presently in South Carolina. The attorneys who are familiar with the record will be out of town on long-scheduled matters for most of the time prior to April 5.-2/

Santee-Cooper has stated it will request a similar extension of time. Counsel for the Regulatory Staff has stated that it has no objection and requests that the time for its response also be extended accordingly to April 23.

-2/ As an additional reason, it is not clear from the Order whether the Commission intended the 5 day mailing time, prescribed in S2. 710, to be applicable in this instance, since it directed that any response be filed within 8 days.
