Dear Mr. Tanner:

In implementation of Section 401(a)(1) of the Federal Water Pollution Control Act Amendments of 1972 (FWPCA), Mr. Norman Billings of your agency issued a certification dated February 28, 1973 (copy attached) with respect to the construction of the Midland Nuclear Plant by the Consumers Power Company.

Mr. Billings' letter certified, in part, that Michigan does not have effluent limitations or standards establishea pursuant to Sections 301, 302, 306, and 307 of the Act.

The purpose of this letter is to formally notify you, pursuant to Section 401(a)(3) of the FWPCA, that the Consumers Power Company has made application'to the Nuclear Regulatory Commission for Operating Licenses for, the Midland N'uclear Plant, Unit Nos.1 and 2.

The Con.

sumers Power Compa'ny application (including the Environmental Report and Final Safety Analysis Report) was docketed by the NRC staff on April 14, 1978 and filed with the Office of the Governor of Michigan, the Department of Natural Resources, and the Office of Intergovernmental Relations.

Section 401(a)(3) provides,'in part, that your February 28, 1973 Section 401(a)(1) certification issued with respect to construction of the Midland facility shall also fulfill the Section 401(a) certification requirement'with' respect to the proposed operating licenses for the Midland facility:Unless, within sixty days after receipt of this notice, the certifyi..g agency modifies its previous certification because of subsequent crianges in' (1) the construction or operation of the facility, (2) V characteristics of the waters into which such discharge is made, (3) r.e vater quality criteria applicable to such waters or (4) applicable

Accordingly, we would appreciate your early advice as to whether, in light of Section 401(a)(3) of the FWPCA and the October 8, 1974 promulgation by EPA, you intend to take any additional certifying action regarding the attached certification for the Midland Nuclear Plant, Unit Nos.1 and 2.
