By a notice of deposition dated and served by mail on March 26, 1979, counsel for Intervenors and the Staff have noticed the deposition of Rcbert H. Gerdes for May 2,1979 in Washington, D. C.

The depenent is to be exanned on six major factual areas (Pacific Intertie, California Power Pool, Contract 2948A, tJaiver of Federal T41eeling stipulations, contracts with other,milities and PG&E activities concernirg 'efferts of other utilities to obtain bulk pcwer resources), and could involve the producticn of subsennr4al numbers of docur:ents.

PG&E filed a nution for a protective order dated March 31, 1979, alleging that the witness is 75 years of age and before retirement he was the president and the cba4 an of the board of PG&E. His atterdance as a witness in a FERC hearing, which will begin in early June 1979,has been requested on behalf of NCPA and Scuthern Cities. It is further contended that the scope of the exam 1 nation and the circ :: stances of the deposition are unreasonable, that the notice calls for a massive new doctr:ent production centrary to the one -- =assive -- search principle, and that protecticn is necessary to avoid repeated exa:::inations of the witness en the same subjects.

, There is sufficient question concerning the appropriateness of th'is deposition and document production request on the dates noticed. to cause the Board to defer Mr. Gerdes' deposition until after the preheerire conference scheduled in Bethesda, Maryland on May 15-17, 1979. The untion and responses will be considered after hearing from counsel at the preh6aring conference, and a decision will be made at that tirre.

Mr. Gerdes' deposition will be deferred frcrn the date scheduled in the notice.
