MOTION FOR FURTHER EXTENSION OF TLME On F trch 9, 1979, Gulf States Utilities Company ("GSU") ,

by its attorneys, appeared specially to request an extension of time to respond or object to a subpoena for the production of documents issued at the instance of the City of Brownsville, Texas, a party to the captioned proceeding for antitrust review pursuant to Section 105c(2) of the Atomic Energy Act.

On March 13, 1979, the presiding Atcmic Safety and Licensing Board granted the extension of time requested by GSU. Since that time, employees of GSU have continued their search for material responsive co the extensive production request. Counsel has reviewed approximately 80% of the documents identified by GSU as possibly responsive to,the request.

However, in view of the extensive material which has

been identified and other ccmmitments of counsel, additional time is needed to complete counsel's review, to meet with Company management, and to finalize decisions regarding the 2046 546 7905290077

production of a number of items. The additional time is also necessary for GSU to contact others possibly affected by production of certain identified documents to determine whether GSU should assert privilege and to give other parties possibly affected by production sufficic time to take ap-propriate action on their own behalf.

Counsel for GSU has been in continuing contact with counsel for the City of Brownsville as well as with other parties to the proceeding to keep them informed.as to progress. - .. -

related to this discovery request. Counsel for the City of Brownsville has stated to the undersigned counsel for GSU that he does not object to the requested two week extension of time.

For the foregoing reasons, GSU requests an additional two weeks within which to respond to the subpoena, thus ex-tending the return date to April 25, 1979.
