This is in further response to a letter dated October 5,1978, from David Dinsmore Comey in which he requested, pursuant to the Freedom of Information Act, documents relating to the Pipe Cracking Study Group Report (NUREG-75-067) and documents relating to GE's Boiling Water Reactor (BWR) pipe cracking problems occurring since 1975.

NRC staff has completed its review of the remaining documents, listed in Appendix'A, which were provided to NRC by foreign sources.

Documents 1 through 6 and portions of document 7 contain information submitted in i

confidence to the NRC by foreign governments and' have been classified

~

pursuant to Executive Order 12065 and are being withheld from public disclosure pursuant to Exemption (1) of the Freedom of Information Act (5 U.S.C. 552(b)(1)) and 10 CFR 9.5(a)(1) of the Commission's regulations.

Portions of document 9 are considered ccnfidential business (propr9tary) information and are being withheld from public disclosure pursuant to exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's regulation.

Copies of documents 7 and 9 with exempt portions deleted and a copy of document 8 are enclosed. One additional document, originated by the Department of State, has been referred to the agency for appropriate disposition and direct response to you.

Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for the denial of documents 1 through 6 and portions of document 7 are the undersigned and James R.

The persons responsi-ble for the denial of portions of document 9 are the undersigned and Harold R. Denton, Director, Office of Nuclear Reactor Regulation.

This denial may be appealed to the Conrission's Executive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
