Sparger Final Report and Supplement 1" - Request for Withholding From Public Disclosure By your application and affidavit, dated May 2, 1978, and May 5, 1978, respectively, you submitted Topical Report NEDE-21821 and requested that it be withheld from public disclosure pursuant to 10 CFR 2.790.
You also transmitted the non-proprietary version of this document, NED0-21821.
By your application and affidavit, dated February 20, 1979, and February 21, 1979, respectively, you submitted Topical Report NEDE-21821-01 and requested that it also be withheld from public disclosure pursuant to 10 CFR 2.790. You also transmitted the non-proprietary version of this document, NED0-21821-01.
Your reasons for requesting our withholding this information were that the detailed design data, test data, test instrumentation drawings, and test process data contained in NEDE-21821 and NEDE-21821-01 have consistently been held in confidence by General Electric. The affidavits state that to the best of General Electric's knowledge and belief, no public disclosure of the information contained in these topical reports has been made.
Public disclosure of this information is likely to cause substantial harm to the competitive position of General Electric and deprive or reduce the availability of profit making opportunities since the information was developed by General Electric with the expenditure of substantial resources. The development cost must be reflected in the prices set for the Feedwater Nozzle Thermal Sleeve /Sparger System and making this information available to competitors without a similar expenditure would provide them an advantage.

General Electric Company March 29, 1979 We have reviewed your applications and reports based on the requirements and criteria of 10 CFR 2.790 and have determined that the above-mentioned documents sought to be withheld contain trade secrets or proprietary commercial information.
We also have found at this time that the right of the public to be fully apprised as to the bases for and effects of the proposed action does not outweigh tha demonstrated concero for protection of your competitive position. Accordingly, we have determined that the information should be withheld from public disclosure.
We therefore approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding Topical Reports NEDE-21821 and NEDE-21821-01 from public inspection as proprietary.
Witholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, assure that the consultants have signed the appropriate agreements for handling proprietary data.
If the basis for withholding this information from public inspection should. change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.
