a On January 4,1979, Intervenor Coalition for Safe Power (Intervenor) 1 request for a stay pending appeal of the Atomic Safety and Licensing Ecard's Partial Initial Jecision cf December 21, 1973 in the captiencd proceeding autho-rizing interim operaticn of the Trojan Nuclear Plant. Intervenor's request for a stay consisted of a nine page " Petition for Stay" with a four page attachment, acccmpanied by a 16 page "Aiemorandura in Support of Stay. "

10 CFR a 2.73d provides that an applicaticn for a stay is to be limited to 10 pages or less. Intervenor's stay request totalling 29 pages is a blatent violation of 1/

this requirement-and, since any response to an application fcr a stay is limited by Section :'.788 to 10 pages or less, may result in substantial prejudice to responding parties who may be unable to properly and adequately respond 1/- ' There is no provision in Section 2.788 tor the filing of a memorandum in support of a stay in addition to the stay apolication itcelf. Such additional filing, in fact, appears to be an attempt to circumvent the page limitation set torth in the regulation. Cf. Toletio :.dison Co.
