Comanche Peak Steam Electric Station, Units 1 & 2, NRC Docket Nos. 50-445A and 50-446A Gentlemen:

On January 2,1979, the Docketing & Service Section received a "... Request To Intervene" filed by the " Citizens for Fair Utility Regulation," whose coordinator lists a Fort Worth, Texas address.

The petition refers to the operating license application filed by Texas Utilities Generating Company for Comanche Peak Steam Electric Station, Unit 1.

It is not clear from the petition whether it was intended to be directed towards the operating license antitrust proceeding or the radiological health, safety and environmental operating license review. The latter has not yet been noticed for hearing.

On today's date, staff counsel (L. Chandler) contacted petitioner by tele-phone to identify the proceeding or prospective proceeding with which petitioner was concerned.

Petitioner advised that the request for intervention was not directed towards the antitrust proceeding. The Docketing and Service Section has been so advised.

Accordingly, it would appear that with respect to the antitrust proceeding, the petition should be disregarded.
