Dear Dr. Larmi:

The Atomic Safety and Licensing Board acknowledges your letter of December 15, 1978, inquiring as to the status of your petition to intervene of September 8, 1978.

That petition authorized Judith H. Johnsrud, Ph.D. and Chauncy R. Kepford, Ph.D. "or other duly authorized representatives" to represent you in these proceedings, and it also request-ed leave to intervene "in light of this affidavit and the formal petition filed on our behalf by Dr. Johnsrud."

For your information, enclosed please find a copy of our Memerandum and Order of October 26, 1978.

There the Board noted that Dr. Johnsrud had applied for intervention on behalf of the Environmental Coalition on Nuclear Power but that she had failed to identify any member of that organ-ization or any authorization for the organization to represent any such member (pp. 4-5).

We also noted that Dr. Johnsrud s petition reflected that an affidavit author-izing representation and setting forth interest on the basis of residence was being filed separately by some mem-bers of ECNP.

Finally, we took note of the receipt of your affidavit but indicated that it did not reflect that the names listed were ECNP members or that the individuals wished to be represented by ECNP.

We held that ECNP had standing, but subject to our receipt of advice from it that the names appearing on your affidavit were ECNP members.

Under Commission regulations, non-lawyers such as Dr.

Johnsrud may not represent other individuals.

An organization may, however, be represented by one of its members.

For that reason, we construed your request as one for intervention u part of ECNP.

The Order scheduling that conference is enclosed for your information.

It provides inter alia, that petitioners for intervention may file supplements to their petitions by January 15, 1979.

We trust that Dr.

Johnsrud will utilize that vehicle to cure the deficiencies in her petition which we have outlined.

I trust this will clarify the status of your petition.

You are of. course welcome to attend the prehearing conference if you have further information concerning your petition of which you wish us to be advised.
