This letter is in reply to your note of October 3,1978, which forwarded for consideration by NRC a letter from Mr. R. G. Rankin of Pittsburgh, 11, 1978.

Mr. Rankin's letter expressed Pennsylvania dated September concerns relating to NRC regulation 10 CFR Part 21, " Reporting of Defects

and Noncompliance."

10 CFR Part 21 was published as a proposed rule in the Federal Reoister on March 3,1975 (40 FR 8832), to implement Section 206, " Noncompliance,"s f o

Public Law 93-438, " Energy Reorganization Act of 1974" and was publish $d as an. effective rule in the Federal Reoister on June 6, 1977 (42 FR 28891).

expressing difficulties similar to those put forth by Mr. Rankin.

Commission staff determined that these comments had merit and on October 3, h
