Dear Mr. Chaiman:
-This is in response to your letter of April 7,1978 regarding the authorization of an NRC FY 1978 supplemental appropriation.
Your letter indicated that, since the total amount authorized to be appropriated to NRC for FY 1978 is sufficiently in excess of the amount requested for appropriation, no new authorization legislation is needed to support the expected supplemental appropriation. You recommended that the specific increase in the tiuclear Material Safety and Safeguards budget authorization be accommodated by way of reprogramming under section 1(b) of P.L.95-209. While the Cc= mission is uncertain whether section 1(b) is applicable under these circumstances, in an effort to comply with the spirit of your letter of March 17, 1978, the Commission has treated the situation in a manner similar to that required under section 1(b).
The FY 1978 Public Works Appropriation Act (P.L. 95-96) contained an appropriation of S281,423,000 for the !!uclear Regulatory Commission.
The FY 1978 Supplemental Appropriation Act (P.L.95-355) which was signed on September 8,1978, contains an apprcpriation of S3,600,000 for NRC. Thus, the total NRC appropriation for FY 1978 is now
$285,023,000. This total is indeed below the 5297,740,000 which was originally authorized by the FY 1978 Nuclear Regulatory Commission Authorization Act (P.L.95-209).
Therefore, we understand that no supplementary authorization act is required.
The Commission approved in January of this year, a supplemental appropriation request for $5,350,000 which included S2,700,000 for the Nuclear Material Safety and Safeguards program that was in excess of the specific authorization for that program. The remaining supplemental appropriation amount for the Inspection and Enforcement program was already within that program's specific authorization.
The Commission again on September 15, reaffirmed that $2,700,000 of the S3,600,000 supplemental funding appropriated be applied to the Nuclear Material Safety and Safeguards program.

This allocation of 52,700,000 in supplemental. funds will increase the budget obligation authority for Nuclear Ma. rial Safety and Safe-guards to S23,960,000 which exceeds the $22,09u,000 authorized in section 1(a) of P.L.95-209. Therefore, to provide for this increase in authorization, the Comission also approved on September 15, a S2,700,000 reduction of the authorization for Nuclear Regulatory Research activit.ies and an increase by the same amount of the author-ization for Nuclear Material Safety and Safeguards. This reduction in the Research authorization will not affect that office's prog am since the funds appropriated for that program were about 59 million less than authorized. The reduction mentioned above would thus involve only a theoretical transfer of cuthorized amounts but not actual trans-fer of appropriated funds.
The justifi ation for the use of the supplemental funds was supplied to the Comitti.e in January of this year with the FY 1978 supplemental request.
Ycur April 7 letter indicated that the Comittee on Interior and Insular Affairs supported the supplemental appropriation request, and had so informed the Chairman of the Subcommittee on Public Works of the House Appropriations Comittee.
In order that the Commission may obligate these supplemental funds before the eno of the fiscal year, it is hoped that the Cormiittee will have nc objection to the immediate reallocation of the authori-zation levels.

This is to advise you that We Commission (with four Commissioners con-curring and Commissioner Gilinsky noting without objection) has approved the reprogramming actions identified in Enclosure 2 of the subject paper.
The Commission has also concurred in the proposed letters to the Congress " revised in a draft letter circulated by the Controller (which hao che prior approval of the ED0).
In this connection, the Commission specifically addressed and approved the allocation of $2.7 million in supplemental authorization for the Nuclear Material Safety and Safeguards program with a corresponding reduction of $2.7 million for Nuclear Regulatory Research activities.

The letters to the Congress were signed by Chairman Hendrie on September 15, 1978 for subsequent dispatch to the appropriate Congressional Committees.
