RECEIPT OF WHITE PAPER ENTITLED RECOMMENDATIONS ON THE PROPER LEGAL AND POLICY INTERPRETATION FOR USING KINETIC SEPARATION PROCESSES AT URANIUM MINE SITES

Dear Mr. Pugsley:

The U.S. Nuclear Regulatory Commission (NRC) staff has received your white paper dated September 13, 2019 (NRCs Agencywide Documents Access and Management System

[ADAMS] Accession Number ML19256C834) on behalf of Western Uranium and Vanadium Corporation (Western). The submittal contains recommendations on legal and policy issues related to the use of the kinetic separation process at uranium mine sites.

The NRC staff appreciates Westerns submittal and is currently evaluating the recommendations contained in the white paper. Given the legal, technical, and policy aspects of the kinetic separation process, the recommendations contained in the white paper warrant careful consideration. The NRC staff will provide Western with an update once a path forward has been determined.

In accordance with Title 10 of the Code of Federal Regulations 2.390 (CFR) of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
