Dear Mr. Shea:

This letter is in response to your letter dated November 24, 1978 requesting Executive Branch views as to whether issuance of an amendment to an export license in accordaace with the application herein-after described wculd be inimical to the common de-fense and security of the United States and whether the proposed export meets the applicable criteria of the Atomic Energy Act of 1954, as amended by the Nu-clear Non-Proliferation Act of 1978 (P.L.95-242):

NRC No. XSNM0ll49 -- Application by Trans-nuclear, Inc. for amendment of NRC license No. XSNM0ll49 for export to the Netherlands via France of 21.045 kilograms of U-235 contained in 22.556 kilograms of uranium enriched to a maximum of 93.3 percent, to add Nukem GmbH, Hanau, FRG; Transnuclear, GmbH, Hessen, FRG; and Transnucleaire, S.A.,

Paris, France as intermediate consignees for processing and transport of the mate-rial.

This highly-enriched uranium in the form of uranium hexafluoride will then be

' shipped to C.E.R.C.A.

in France for fabri-cation into fuel elements for the Petten High Flux Reactor in the Netherlands.

The proposed export via the added intermediate consignees would take place pursuant to the Additional Agreement for Cooperation Between the United States and the European Atomic Energy Community (EURATOM) as confirmed in a letter from the Delegation of the Com-mission of the European Communities.

EURATOM has ad-hered to the provisions of its Agreement for Coopera-tion with the United States.

. The Executive Branch has reviewed this application and concluded that the requirements of the Atomic Energy Act and P.L.95-242 have been met and that the proposed export will not be inimical to the common defense and security of the United States.

A detailed analysis for this application was submitted to the Commission on April 4, 1978 and a more recent detailed analysis for France, the FRG and the Netherlands was submitted on December 8, 1978 (NRC Nos. XS NM-12 3 2, 1241, 1212 and 1238).

There are no material changed circumstances associated with the new application from those existing at the time of those submissions.

On the basis of the foregoing, the Executive Branch recommends that the license be issued.
