MONDAY, FEBRUARY ll, 1985, COMMISSIONERS' CONFERENCE ROOM, D.C. OFFICE (OPEN TO PUBLIC ATTENDANCE)
The Commission discussed with the Staff recommendations for changes to the Commission's treatment of material false statements.
The Commission by a vote of 4-1 (Commissioner Asselstine disagreeing) directed ELD and OGC to develop a modified rule on materia) false statements that would include a revised definition of material false statements which would incorporate the following:
any written or oral statement that is made knowing that it is false, or is made with careless disregard for its accuracy or completeness.
any omicsion that was done knowing that the omission ucs significant and was done with intent to deceive.

The Commissicn requested OGC and ELD tc. identify other. elements that the Commission should eddress including a category of statements which are made in ignorance or lack an intent to deceive and which would constitute a violation of rules.
