AGREEMENT TO TERMINATE STANDBY TRUST AGREEMENT FOR THE AMERICAN CENTRIFUGE LEAD CASCADE FACILITY: LICENSE NUMBER SNM-7003

Dear Mr. Cutlip:

The purpose of this letter is to provide you with an agreement, signed by the U.S. Nuclear Regulatory Commission (NRC), to terminate Centrus Energy Corp.s (Centrus) Standby Trust Agreement (STA) dated January 31, 2013. The STA was used by American Centrifuge Operating, a subsidiary of Centrus, as a decommissioning funding instrument for the recently decommissioned American Centrifuge Lead Cascade Facility (LCF) in Piketon Ohio.

By letter dated September 23, 2019, the NRC informed Centrus that it had approved the Final Status Survey report confirming that the LCF site met the unrestricted release requirements of Title 10 of The Code of Federal Regulations, (10 CFR) Part 20.1402, (Agencywide Documents Access and Management System [ADAMS] Accession No. ML19228A096). Accordingly, the NRC found it acceptable to terminate the STA, as outlined in a separate letter to Centrus also dated September 23, 2019 (ADAMS Accession No. ML19238A138). Because Section 16 of the STA requires that it be terminated by a written agreement between the NRC, the Grantor (Centrus), and the Trustee (U.S. Bank National Association), the NRC is providing you the enclosed agreement signed by Andrea Kock of the NRC for your review and signature. If you agree with its terms, please sign the agreement and provide it to U.S. Bank National Association for review and signature and provide an electronic copy of the signed agreement to Yawar Faraz at Yawar.Faraz@nrc.gov.

In accordance with10 CFR 2.390 Public inspections, exemptions, requests for withholding, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of NRCs ADAMS. The ADAMS is accessible from the NRC Web site at http://www.nrc.gov/reading-rm/adams.html.
