Trans-Eastern Inspection Services, Inc., 35 West Point Park, Washington, Pennsylvania 15301 ("the licensee") is the holder of Byproduct Material License 37-14855-01 ("the

license") issued by the Nuclear Regulatory Commission ("the Commission").

The license authorizes the possession and use of byproduct material under certain conditions specified therein. This license was triginally issued on October 22, 1971. The present expiration date of the license is March 31, 1982.

II On January 3,1979, the licensee's activities authorized by License 37-14855-01 and located at your field site near Kclkaska, Michigan, were inspected by a representative (s) of the NRC Office of Inspection and Enforcement for nealth and safety purposes.

On January 25, 1980, the Commission sent Invoice 0498M to the licensee requesting payment within 30 days of the inspection fee of $980 required by 10 CFR 170 of the Commission's regulations.

A second notice of payment due, together with a Notice of Violation, was sent to the licensee on March 6,1980. A final notice of payment due was sent to the licensee on April 11, 1983.

The licensee failed to respond to thrce invoices.

Conscquently, on July 1,1980, the Chief, License Fee 800825 4 03

. Management Branch, Office of Administration, issued an Order to Show Cause

("the Order"), directing the licensee to show cause why the license should not be revoked pemanently. As an alternative to filing an answer, the Order provided that, if papent of the fee were made within 20 days of the date of receipt of the Order, the Director of Administ'ation or the undersigned would issue a subsequent

r Order teminating the revocation proceeding.

In response to the Order, the licensee follcued this alter :stive procedure and paid the inspection fee of $980.

III Accordingly, in view of the payment of the inspection fee under the tems of the Order and, pursuant to the Commission 3s " Rules of Practice" in 10 CFR Part 2, IT IS HEREBY ORDERED THAT:
