Dear Mr. Merigold:
This is in response to your letter dated March 27, 1979 in which you requested, pursuant to the Freedom of Information Act, a copy of the winning proposal for RFP No. RS-RES-78-193.
Listed in Appendix A are the initial and Best and Final proposals and related correspondence submitted by Mathematical Applications, Incor-porated (MAGI), which resulted in the award of Contract No. NRC-04-79-179.
Document 6 and portions of documents 2, 4, and 5 listed on Appendix A, are considered by MAGI to be confidential business (proprietary) information end are being withheld from public disclosure pursuant to exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5 (a)(4) of the Commission's regulations.
Copies of documents 1 and 3 and portions of documents 2, 4, and 5 with exempt portions deleted are enclosed. We have asked MAGI to rejustify their proprietary claim, and will let you know whether any additional portions of these documents may be released.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.
The persons responsible for this denial are the undersigned and Edward L. Halman, Director, Division of Contracts.
This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.
As provided in 10 CFR 9.11, any such appeal must be in writing addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision".
