Dear Mr. Levine:

We have received your letter of January 31, 1979, in which you supported a request that 10 CFR Part 73 be revised to exempt from the requirements of Part 73, SNM fuel in a fuel element which is not readily.;eparated from other radioactive material and which has a total external radiation dose rate in excess of 0.4 rems per hour per gram of U-235 at a distance of three feet. We have discussed this with you by telephone on February 12, 1979 during which time you indicated that you would like to have the request be considered as a petition for rule making.

We have forwarded your letter along with Dr. Williamson's letter of October 30, 1978, to our Office of StandardsDevelopment for processing as a petition for rule making.
