Dear Mr. Smith:

In response to your letter of February 8, 1979 and in accordance with 10 CFR 2.201, the attached reply addresses the Notice of Violation which was included as Appendix A of the referenced Inspection Report. The noted violations involved: (a) shipping radioactive materials without authorization in a general or specific licensa and (b) the failure to maintain records of radioactive material released to the environs.

DUQUESNE LIGHT COMPANY Beaver Valley Power Station Unit No. 1 REPLY TO NOTICE OF VIOLATION Inspection No. 79-01 Letter Dated February 8,1979 INFRACTION A Description Of Infraction (79-01-01) 10 CFR 71.3, " Requirement for License", requires that no licensee subject to the regulations in this part shall (a) deliver any licensed materiala to a carrier for transport or (b) transport licensed material except as authorized in a general license or specific license issued by the Commission, or as exempted in this part.

Contrary to the above, on October 27, 1978,'188 Ci of licensed materials were delivered to a carrier for transport without a general or specific license and no exemption in 10 CFR 71 was applicable.

Discussion Of Infraction Because this was the station's first type B shipment, chere was an uncertainty as to whether the vendor or Duquesne Light Company was responsible for the notification prior to the first use. Now that this requirement is understood, corrective steps have been made and a letter has been sent to the Director, Office of Nuclear Material Safety and Safeguards, registering a cask daat will be used in a subsequent shipment.

Compliance has been achieved at this time and no further action is plcnned.

DEFICIENCY B Description Of Deficiency (79-01-02)

Technical Specification (TS) 6.10.2.e requires that the licensee maintain records of gaseous and liquid radioactive material released to the environs for the duration of the facility.

Contrary to the above, no record was maintained of particulates released via elevated release point VS-107 for the time period March 22-30, 1978.

Discussion Of Deficiency Results of the filter paper analysis are recorded on the applicable Radeon form and stored in the ND 4420 memory. However, in this instance, the computer memory was out of service due to a malfunction and the form used to record the results could not be found. A review of the records indicated that this was the only sample of this type that could not be substantiated. A log is now being used to ensure that the sample records are filed on a timely basis for improved reliability.

Compliance has been achieved at this time and further action is not planned.
