(a) License No. DPR-28 (Docket No. 50-271)

(b) VYNFC letter to USNRC dated March 2,1979 (WVY 79-25)

Dear Sir:

Subject:

Licensing Fee for Primary Containment Leak Rate Testing Exemption Our letter, Reference (b) requested an exemption f rom 10 CFR Part 50, Appendix J testing requirements. This exemption, when approved, will eliminate the necessity to perform a type A, primary containment leak rate test during our next refueling outage.

We have determined that the staff review of this proposal requir2s an approval that involves a single safety issue and is deemed net to involve a significant hazards consideration. For these reasons, Vermont Yankee proposes this exemption as a Class III submittal. A payment of

$4,000.00 is enclosed.

Vermont Yankee Nuclear Power Corporation believes that the NRC revised fee schedule is illega3.. We are aware that this fee schedule is being contested before the U.S. Court of Appeals for the Fifth Circuit and, therefore, submit the enclosed fee under protest without waiving our right to contest the validity of this fee or the entire NRC fee schedule, and without waiving any right to recover, in whole or in part, all fees paid or to be paid under the invalid fee schedule.

We trust this submittal is acceptable to you; however, should you I have any questions, please contact us.

Very truly yours, VERMONT YANKEE NUCLEAR POWER CORPORATION M
