This letter is in reply to your February 18, 1979 letter to Chairman i

Hendrie which expressed your concerns about licensing delays in the i

issuance of the Black Fox Nuclear Station construction permit.

Because the Black Fox construction permit is the subject of a hearing before an

z NRC Atomic Safety and Licensing Board and rulings by that body are sub-ject to review by the Commissioners, it wou'd be inappropriate for 1

Chairman.Hendrie to respond to your concerns.

Accordingly, I am pleased to respond to your letter.

As you know, the Black Fox proceeding was a highly contested case with 5

a variety of complex technical issues which resulted in an extended hearing.

However, on Wednesday, February 28, 1979, the hearing ended.

The Licensing Board now has the extensive record of the hearing before it for decision. We anticipate that the Licensing Board will release its decision on whether construction permits should issue sometime in the spring of this year.
