TUGCO'S MOTION FOR EXTENSION OF TIME On January 31, 1979, the Public Utilities Board of the City of Brownsville served by mail its interrogatories and request for production of documents to TUGCO, et al in the South Texas docket, in which TUGCO, et al is a party intervenor. Pursuant to 10 C.F.R. S2.740b, S2.741 and S2.711 TUGCO hereby moves for extensions of time as follows:

(a) to and including. March 7, 1979 within which to file objections or motions for protective orders or other appropriate pleadings, (b) to and including April 1, 1979 within which to file answers or produce documents in response to interrogatories or requests which are not objected to or as to which a protective order is not sought and, (c) to and including April 1, 1979, or 30 days from the date when a Board order is received 790315DS56

(whichever is later) denying objections or requests for protective orders; and (d) April 1, 1979 or 20 days from the date on which a Board order is received (whichever is later) requiring or permitting a limited or partial or modified response in accordance with objections or requests for protective orders as proposed by TUGCO.

It should be noted that the subject interrogatories and document requests are quite extensive and far-ranging and require a very considerable effort even to prepare objections and requests for protective orders, much less res-ponses. The timing of these initial interrogatories and document requests comes not only very late in the discovery process (which has been open in South Texas for more than six months) but also overlaps with the period when knowledgeable personnel are occupied with responding to interrogatories and document requests of the NRC Staff. Accordingly, the time routinely permitted by NRC Regulations is not sufficient for response or pleadings with respect to these interrogatories and document requests, and extensions are warranted.
