Discussion:
Enclosed for the information of the Comission are copies of the Executive Branch response on a pending export license application.
Copies of,the Executive Branch cements have been placed in the Public Document Room. A Comission Action Paper will be forwarded soon.
Comissioners are requested to advise the staff of any particular issues or information which they can identify at this stage and which they wish included in the staff's an sis.

to whether issuance of an export license in accorddnce with the appplication hereinafter described would be inimical to the common defense and security of the United States and whether the proposed export meets the applicable criteria in the Atomic Energy Act as amended by the Nuclear Non-Proliferation Act of 1978:
NRC No. XUO8434 -- Application by Mitsubishi International Corporation for authorization to export to Canada 538,511 kilograms of natural uranium in the form of yellowcake ore concentrate.
This material will be converted to uranium hexafluoride and re-imported into the USA for enrichment and subsequent re-export to Japan as LEU power redctor fuel, subject to the NRC licensing process and Executive Branch consideration.
The proposed export would take place pursuant to the Agreement for Cooperation Between the United States and Canada as confirmed in a letter from the Canadian Atomic Energy Control Board dated January 12, 1979.
Canada has adhered to the provisions of its Agreement for Cooperation with the United States.
The Executive Branch has concluded that the export contemplated will not be inimical to the common defense and security of the United States and is consistent with the provisions of the Atomic Energy Act of 1954, as amended, and with the Nuclear Non-Proliferation Act of 1978.
A detailed analysis for Canada was submitted December 18, 1978.
(NRC license application XSNM-1339).
There has been no material change in circumstances re-garding Canada since that submission.

Regarding export application XU-8434, I would like to confirm:
(a) that the transfer of the material identified on said licence application, namely 538,511 Kg U in 635,036 Kg U03 8 will be subject to the terms and conditions of the Agreement for Cooperation Concerning Civil Uses of Atomic Energy between the Government of Canada and the Government of the United States of America.
(b) that the ultimate consignee, E1 dorado Nuclear Limited, port Hope, Ontario, is authorized to receive and possess the material.
