  • w on February 13, 1979, the Appeal Board entered an Order allowing Petit'.oner, Natural Resources Defense Council (NRDC), to intervene in this proceeding on a discretionary basis. To that extent, the January 9, 1979 decision of 'the Licensing Board denying NRDC's petition to intervene ws reversed.

NRDC filed a Statsent of Contentions on October 6,1978.

Applicant filed its Response to this Statement of Contentions on October 23, 1978. On October 31, 1978, NRDC filed its Reply to Applicant's Response to Contentions. The Staff has not filed any response to these contentions although counsel briefly stated its position on contentions at a special prehearing conference held on October 24, 1978. Other counsel also participated to scme extent in the discussion of NRDC contentions at the prehearing conference.

n The Licensing Board believes that the issues which NRDC wishes to plead as the basis for its discretionary intervention, should be condensed and reforatlated as objective statements of issues.

Explanations, discussion or arguaent regarding contentions should be separately set forth.

Sane updating to reflect the current situation might also be helpful. The Staff should prepare a written response to these statements of issues, clearly setting forth its position with regard to each together with the underlying reasoning. The Applicant may file such further responses as it deems necessary or helpful.

In order to expedite thh aspect of the proceeding upon a reasonable basis, counsel for the parties involved are requested to confer arrong th'emselves and to exchange drafts of the above-described pladings or responses as soon as possible. The Licensing Board will hold a conference with counsel representing NRDC, the Applicant and the Staff, to consider the NRDC contentions and rule upon their namic:sibility, at 10:00 a.m. on Tuesday, March 13,1979, at 4350 East West Highway, U. S. Nuclear Regulatory Cmmission Hearing Roan, 5th Floor, Bethesda, Maryland.
